Qualifications
  1. 5-8 years of experience in human resources with an emphasis on labor relations in higher education and a demonstrated ability to work with professional groups and individuals.
  2. Juris Doctorate with License to practice law in New Jersey or comparable experience as a faculty member.
  3. Must possess excellent analytic skills, strong writing and research skills, enthusiasm and initiative.
  4. Must possess an understanding of a variety of HR issues with a tactical, hands-on approach.

Penn State May Loan Athletic Department Money to Pay Off NCAA Fines

Aller/Getty Images(STATE COLLEGE, Pa.) -- Penn State University is considering a loan to its athletic department in an effort to pay the $60 million fine imposed by the National Collegiate Athletic Association for its role in ignoring past sexual abuse of young boys, according to Penn State President Rodney Erickson.

?And in all likelihood the university will have to extend the athletic department a long-term loan that they can pay back as they get on their feet, and as we adjust their budget going forward in the football program,? Erickson said Sunday on CBS?s Face the Nation.

He also said that the university would dip into the athletic department?s reserve fund along with a long term loan from the school itself.

In the wake of the Jerry Sandusky child sex abuse scandal, which has sent shockwaves through the State College, Pa., community over the past eight months, the NCAA hit the university with the unprecedented $60 million fine and capped scholarships for players.

The massive fine and harsh sanctions come in the aftermath of a damning report issued by former FBI director Louis Freeh, which harshly criticized the university and longtime football Coach Joe Paterno for failing to take action in the sex abuse case of Sandusky, his former assistant coach.

The university president promised the fines will be paid from athletic reserve funds.? Penn State makes $60 million on football alone every season.? The fines will not affect the education of the other 80,000 non-football playing students, Erickson said.

In addition to the fines, the university will likely face multiple lawsuits from abuse victims.? Erickson said Penn State is properly insured for liability but is not looking for a long drawn-out fight in court.

?We hope to be able to settle as many of these cases as quickly as possible.? We don?t want to, if at all possible, drag victims through another round of court cases and litigation,? he said.

Penn State faces significant financial challenges in the years to come.? The university already has about $1 billion in debt and risks a downgrade to its creditworthiness, according to a report put out by Moody?s Analytic last year.

Unrelated to the university?s money problem, Erickson also issued an on-screen apology for the school for the first time.

?We?re deeply sorry and sad, regretful that this happened at our university.? We want to do the right thing.? We want to help them in their healing process,? he said.

Forest senior Jordon Austin has been busy this summer.

The two-sport standout has drawn interest from colleges for his talent in both baseball and football.

Austin?s recruitment is far from finished, but it?s starting to take shape.

?Right now, I am leaning toward playing baseball in college,? Austin said. ?I also want to stay in Florida.?

Over the summer, Austin participated in the Perfect Game National Showcase in Minnesota.

?There were over 100 scouts at each game and I thought I did pretty well,? said Austin, whose 6.55 time in the 60-yard dash and 88-mile per hour throw from the outfield were among the best for outfielders at the event.

The first school to offer Austin in baseball was Florida International, but he also has plenty of interest on the gridiron.

Austin earned a football offer from Wofford earlier this year and has also heard from Florida, UCF, Marshall, Samford and Akron.

He said most schools recruiting him in football want him as a safety or outside linebacker.

At 6 feet and 195 pounds, Austin runs a 4.4 in the 40-yard dash and also has a bench press of 330 pounds, giving him an impressive combination of speed and power.

Overall, Austin said he has heard from more than 20 Division I schools for football.

He was set to take part in a camp at UCF, but the Golden Knights cancelled the event. UCF has kept in continuous contact with Austin, while Samford and Akron are the newest schools on his radar.

TOUGH SLATE: West Port High has one of the toughest two-game stretches of any program in the state. The Wolf Pack will visit Class 3A state runner-up Madison County on Oct. 5 and, after a bye week, will travel to face district rival Tallahassee Lincoln, another state power.

?We?ve got one of the toughest schedules around, but I really want to go out and play the best teams that we can play,? said West Port coach Ryan Hearn. ?(Madison County) is a great football team and you?ve got that name recognition with them. Our guys know who they are and it?s making them work harder.?

The open date came up for West Port after Crystal River dropped the Wolf Pack from their schedule.

Hearn said he had the chance to face Trinity Catholic, Fort Lauderdale St. Thomas Aquinas or Madison County and opted to travel to Boot Hill Stadium in the always-tough Big Bend area to face the Cowboys.

?We wanted to get out of the county and play someone different,? he said. ?We really didn?t want to go down to Fort Lauderdale and I really like the opportunity that Madison County gave us.?

UP FRONT THAT COUNTS: Dunnellon coach Frank Beasley has been impressed with the effort his offensive line has given over the summer.

?Our offensive line is really going to be a special group,? said Beasley, who praised the efforts of line coach Tommy Sutton. ?They are big, strong and physical.?

Alex Stetz (270 pounds), Cody Ingals (250), Will Thomas (260), Nick Weissman (245), Keandre Brooks (285) and Alan Perotta (290) will team with tight ends Connor Wentz (245) and Bo Dewitz (210) to give the Tigers an imposing front wall.

?All have had outstanding summers and we expect big things from those kids,? Beasley said. ?We?ve had some great offensive lines here and this group is the most complete from top to bottom.?

Dunnellon has also moved away from the wing-T offense and gone exclusively to the pistol formation.

?This fits our players? skill set and allows us to maintain the downhill run mentality we have developed over the years,? Beasley said. ?We?ve created a system to control the tempo of the game and have worked extremely hard to install and develop this offense throughout the summer.?

Led by the offensive line, the Tigers also averaged 97 percent attendance in the weight room at workouts in July.

?This shows we have outstanding senior leadership and our kids fully understand the process,? Beasley said. ?We?ve got a very mature group that serve as role models for our younger kids.?

Penn State loses one sponsor, others could follow

STATE COLLEGE, Pa. (AP) ? State Farm is pulling its ads from Penn State football broadcasts, while General Motors is reconsidering its sponsorship deal and Wall Street is threatening to downgrade the school's credit rating, suggesting the price of the sexual abuse scandal could go well beyond the $60 million fine and other penalties imposed by the NCAA.

Bloomington, Ill.-based State Farm said it had been reviewing its connection to Penn State since the arrest of retired assistant football coach Jerry Sandusky last November. The insurance company said it will pull ads from broadcasts of Nittany Lions home games but continue to advertise during Penn State's away contests.

"We will not directly support Penn State football this year," State Farm spokesman Dave Phillips said Tuesday. "We just feel it was the best decision."

State Farm had no immediate information on how much money is at stake.

The NCAA imposed unprecedented sanctions against Penn State on Monday, including the fine, a four-year bowl ban and a sharp reduction in the number of football scholarships it may offer.

The governing body also erased 14 years of victories, wiping out 111 of coach Joe Paterno's wins and stripping him of his standing as the most successful coach in the history of big-time college football.

NCAA President Mark Emmert said he relied on a report by former FBI Director Louis Freeh, who found that Paterno and three top officials concealed child sexual abuse allegations against Sandusky more than a decade ago to protect the school and its powerful football program.

With Penn State's once-sterling reputation in tatters, the university could face an exodus of sponsors unwilling to have their brands linked to scandal, said Kevin Adler, founder of Chicago-based Engage Marketing Inc.

Adler said he would advise current sponsors to pull out of their deals with Penn State, adding that most contracts have morality clauses giving advertisers an out.

"I think the public perception is pretty clear and definitive at this point. That brand is damaged beyond the point of short-term repair. It is the sponsorship partner's obligation first and foremost to look after the health of their own brand," Adler said. "None of the sponsors owe Penn State anything."

So far, though, Penn State appears to be hanging on.

GM spokesman Pat Morrissey said the automaker is reviewing its sponsorship but has not made a decision. Morrissey did not immediately return a call about the value of the sponsorship deal.

Other sponsors said they plan to stick with Penn State, including Purchase, N.Y.-based PepsiCo Inc., Pittsburgh-based PNC bank and Pennsylvania's largest health insurer, Highmark Inc.

"Highmark's partnership with Penn State is about health and wellness. We do have a sponsorship with the athletics program. While we routinely evaluate all of our sponsorships, we plan to continue at this time," spokesman Aaron Billger said.

PNC Financial Services Group issued a statement after the July 12 release of the Freeh report that its "ongoing engagement with the university signals our support of the students and traditions of Penn State. ... We believe that the university will learn from this experience and become stronger."

Bank spokesman Fred Solomon said the NCAA sanctions have not changed PNC's position.

Pepsi spokeswoman Gina Anderson said Tuesday the company also stood by its recent statement in response to the Freeh report.

"We are deeply disturbed by the findings of the investigation and the conduct of certain individuals at Penn State University, but will continue to honor our longstanding contract as a campus beverage provider," the statement said.

Moody's Investors Service said Tuesday that it may cut the school's Aa1 rating. The Freeh report, along with the NCAA sanctions, could hurt enrollment and fundraising, and the school is still under state and federal investigation, the rating agency said.

A downgrade could make it more expensive for Penn State to borrow money for expansion or other projects.

Around Happy Valley, as the university and the surrounding area are known, Penn Staters and business owners worry that the NCAA sanctions will drive down attendance at home games and hurt the hotels, restaurants and university-themed clothing shops that rely on the Nittany Lions' loyal football fans.

"Football is absolutely intertwined with the university, therefore the town," said graduate student Will Ethier. "Such hard hits really will hit the town economically." He added: "If one gets sanctioned, everybody else gets sanctioned."

Average attendance at the 106,500-seat Beaver Stadium has long been robust. It ranked no lower than fourth nationally in average attendance each year since 1991, a university spokesman said. And Penn State's alumni association, with more than 165,000 members, is billed as the largest in the world. Already, the team has sold 85,000 season tickets for 2012.

Still, Matt Powell, an analyst with SportsOneSource, a Charlotte, N.C.-based provider of sports business information, said sales of Penn State clothing are dropping, from about $80 million in 2010 to $60 million after the scandal broke last year to possibly $45 million this year.

Chris Stathes, who has a daughter at Penn State and manages a Waffle Shop in State College, said he would not be surprised to see 20,000 or 30,000 empty seats at Beaver Stadium. He said some fans might not want to make the drive to see home games in State College, several hours from Philadelphia and Pittsburgh.

"What are you going to watch for?" Stathes said. "They can't advance to any postseason bowl game or anything like that. People are still going to be disgusted over the whole thing."

Several Penn State fans, whether they buy tickets or watch on TV, insisted they would not lose interest in the team.

"We will go to every game," said Sam Zamrik, 80, a retired professor of engineering and a season ticket holder for 40 years. "They need our support."

First-year head coach Bill O'Brien said of the team's fans Tuesday: "I would tell them to renew their season tickets. I would tell them to move forward, turn the page. I would tell them we've got a football team that's working extremely hard for this upcoming season."

Finally, exit interviews that include written questionnaires completed by the employees can serve as evidence as to the employees? physical condition at the time of termination.

When the layoffs occur, the company should handle them as sensitively as possible. Losing a job is a traumatic experience for anyone; clumsy communications from the employer can inspire a worker to seek retribution. To the extent that the employer can help affected employees, it should do so. For example, it may want to offer resume preparation or outplacement services or employee assistance programs for those who need emotional support. Also, if the company can afford them, it may want to offer severance payments to the employees in return for their written agreement to forego any future claims against the company. Finally, though it may seem unlikely, the company should have contingency plans in place should any of the employees become violent, either at the time of the layoff or later.

To defend against exaggerated or fraudulent claims, the risk manager should ask the broker and the insurance company to coordinate claims handling through one office and one senior claims adjuster. She should also request that the insurer assign the defense of all cases to one law firm. To assist in the defense, she should make relevant records, such as videos, employee files, job descriptions, and exit questionnaires, easily accessible to the attorneys and any medical specialists the firm may hire. Finally, she should identify key personnel who may be available to testify as to job requirements and conditions, and she should make a list of their names and contact information available to the attorneys.

Cutting jobs is one of the most difficult things any organization must do. The goal of a workforce reduction is to lower the firm?s costs; uncontrolled workers? compensation expenses resulting from the action may wipe out any benefits from it. Careful planning and handling of the action and its aftermath can go a long way toward ensuring that the company?s pain will not be for nothing.

Federal court upholds S.D. abortion suicide advisory

A federal appeals court has upheld a portion of a 2005 South Dakota law that requires a doctor to tell a woman seeking an abortion that she faces an increased risk of suicide.

In a 7-4 opinion on Tuesday, the 8th Circuit Court of Appeals said medical research has shown that the risk of suicide is higher for women who abort compared with women who don?t.


?The statute does not require the physician to disclose that a causal link between abortion and suicide has been proved.? The disclosure is truthful, as evidenced by a multitude of studies published in peer-reviewed medical journals that found an increased risk of suicide for women who had received abortions compared to women who gave birth, miscarried, or never became pregnant,? the opinion said.

?Various studies found this correlation to hold even when controlling for the effects? of other? potential? causal factors? for? suicide,? including? pre-existing depression, anxiety, suicide ideation, childhood sexual abuse, physical abuse, child neuroticism, and low self-esteem.?

The appeals court said the suicide advisory is ?non-misleading? and ?relevant to the patient?s decision to have an abortion.?

The ruling came in a lawsuit filed by Planned Parenthood Minnesota, North Dakota, South Dakota against former South Dakota Gov. Mike Rounds and Attorney General Marty J. Jackley.

The full appellate panel agreed to rehear the case after a three-judge panel upheld U.S. District Judge Karen Schreier's decision to overturn the requirement, The Associated Press reported.?The decision by the full 11-member court vacates the permanent injunction against enforcing the provision, according to the AP.

"On its face, the suicide advisory presents neither an undue burden on abortion rights nor a violation of physicians? free speech rights," the decision said. ?

Planned Parenthood Minnesota, North Dakota, South Dakota took issue with the appeals court decision, saying it "allows the greatest intrusion by the government into the patient doctor relationship to date."

"The bottom line is that women don?t turn to politicians for advice about mammograms, prenatal care, or cancer treatments. Politicians should not be involved in a woman?s personal medical decisions about her pregnancy," Planned Parenthood said in a statement.

Leslee Unruh of the Alpha Center pregnancy counseling center in Sioux Falls, which seeks to persuade women not to seek abortions, called the decision a victory for South Dakota women.

?We are thrilled. This has been a long time working from 2005. It?s a long, long haul. We are so excited for the women of South Dakota that they have this victory,? she told the AP.

The suicide advisory was part of a larger 2005 law requiring South Dakota doctors to provide women with certain information before an abortion can be voluntary.

Still entangled in the courts are two sections of a separate 2011-12 law?dealing?with a 72-hour waiting period for abortions and requirements for "pregnancy help centers," Jackley said.

RGEs facing this conundrum are unable to access affordable debt capital. When profitable RGEs are unable to get affordable working capital loans, this has a direct impact on employment. For example, affordable capital is not within their reach because:

Intangible assets are not included as balance sheet assets, and make up a large percentage of company assets.

Companies are borrowing against receivables with collection lag times of up to 190 days.

Credit scores by banks (FICO) do not reflect current cash flow analysis and a companys ability to repay a loan.

Banks collect payments once a month and sell SBA guarantees on a secondary market, increasing loan loss.

Tighter government regulation of banks has made them more risk adverse.

Additionally, SBA loan guarantees require tangible collateral with excludes many RGEs and without and industry standard for intangible assets, pro growth public sector policies cannot succeed.

Automotive supplier AFS America to bring new jobs to Columbus

Korean automotive parts supplier, AFS America LLC, plans to open a manufacturing facility and warehouse in Columbus.

The company, a subsidiary of parent company NVH Korea Co., Ltd., will create 65 new jobs and invest more than $3 million in this facility.

AFS America LLC will produce automobile floor mats and cargo trays in the Columbus, Georgia facility.? The company is a key supplier for Hyundai Mobis, Kia Motors Manufacturing Georgia (KMMG), Hyundai Motors Manufacturing Alabama (HMMA) and General Motors. The new facility is expected to begin its operations by fourth quarter 2012 and be fully operational by 2013.

"We are excited to start our U.S. operations and take advantage of the highly skilled workforce in the Columbus, Georgia Region. (AP) ? Organizers say several thousand people are expected to turn out Sunday in Washington for a march ahead of an international AIDS conference that's getting under way in the city.

The "Keep the Promise" march, which is set to begin at 2 p.m. Eastern time at the Washington Monument, is being organized by the Los Angeles-based AIDS Healthcare Foundation. Organizers say their aim is to remind world leaders and policymakers that AIDS remains a threat to global health.

They're calling for funding of programs that fight AIDS and they want lower prices on AIDS drugs. They also are pressing for universal access to condoms and increased rapid HIV testing.

The 2012 International AIDS Conference opens on Sunday evening and runs through July 27.

Kids might not need to sit quietly in their desks, raise their hands, and follow a strict schedule to end up with a decent education: A study from the Canadian Journal of Behavior Science suggests that homeschooled students outperform public school-educated kids.

Researchers administered standardized tests in math and reading to the two groups of students; The homeschoolers who followed a structured, curriculum-based program scored as much as 2.2 grade levels above their public school peers. (Homeschooled students who followed an unstructured or a curriculum-free learning plan scored lower than both structured homeschoolers and traditionally-educated students.) With a very small group of subjects ? just 74 kids ? the results are hardly conclusive, but they do follow the pattern of previous studies that showed the success of homeschooling methods.

The most comprehensive academic homeschool study ever completed ?? the Progress Report of 2009: Homeschool Academic Achievement and Demographics released by the National Home Education Research Institute ? concluded that homeschooled students score an average of 34 to 39 percentile points higher than their peers on standardized achievement tests. Unlike the Canadian study, the researchers for the NHERI study included more than 11,000 students from all 50 states, and included three well-known tests? California Achievement Test, Iowa Tests of Basic Skills, and Stanford Achievement Test.

How are results like these possible? Sandra Martin-Chang, a professor at Concordia University and the lead author of the recent Canadian study, said that the structure of homeschooling ?may offer opportunities for academic performance beyond those typically experienced in the public schools [including] smaller class sizes, more individualized instruction, or more academic time spent on core subjects such as reading and math.?

Still, at the very core of these findings is a major flaw: standardized testing. Are the tests that the results are based on really a true measure of how smart, well-educated, creative, or talented our children really are? I think most parents would agree with me when I respond with an emphatic, ?No!? But in a numbers-driven educational system, it is difficult for parents to separate true learning from results on a test. All parents, homeschoolers or not, have a tough choice to make? do I want my child to be passionate about learning, or do I want her to ace her tests? And is it ever possible for kids to do both?
